1. Acceptance of Terms

Welcome to SmartWallet AI. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and My India Now ("Company," "we," "us," or "our") governing your access to and use of the SmartWallet AI mobile application and related services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.

3. Service Description

SmartWallet AI is a personal finance management application that provides:

• Single device usage

3.2 Premium Features

• Unlimited transaction history
• SMS auto-import for Indian banks (50+ supported)
• AI-powered financial insights and recommendations
• Advanced reports and analytics
• Custom categories and tags
• Export to PDF, CSV, and Excel
• Cloud sync across multiple devices
• Priority customer support
• Ad-free experience
• Family sharing (Annual plan only)

3.3 Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

4. Eligibility

To use the Service, you must:

• Be at least 13 years of age
• Be at least 18 years of age to subscribe to Premium plans or make purchases
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Provide accurate and complete registration information

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

5. Account Registration

5.1 Account Creation

6. Subscriptions and Billing

6.1 Subscription Plans

We offer the following subscription options:

• Premium Monthly: Billed monthly with full Premium features
• Premium Annual: Billed annually with a discount (equivalent to 2 months free) and includes Family Sharing

6.2 Billing

• Subscriptions are processed through the Apple App Store or Google Play Store
• Prices are displayed in your local currency and may include applicable taxes
• Subscriptions automatically renew unless cancelled before the renewal date
• You will be charged through your app store account

6.3 Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following notice to you.

6.4 Cancellation

• You can cancel your subscription at any time through your device's app store
• Cancellation takes effect at the end of the current billing period
• You will retain access to Premium features until the end of the paid period
• No refunds are provided for partial subscription periods

6.5 Refunds

Refund requests are handled by the Apple App Store or Google Play Store according to their respective refund policies. We do not process refunds directly.

7. Free Trial

We may offer free trials of Premium features at our discretion:

• Free trials are available to new users only
• You may be required to provide payment information
• If you do not cancel before the trial ends, you will be charged for the subscription
• We reserve the right to modify or discontinue free trials at any time

8. User Conduct

When using the Service, you agree NOT to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Use the Service for illegal financial activities
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble the Application
• Use automated systems or bots to access the Service
• Transmit viruses, malware, or harmful code
• Collect personal information of other users
• Use the Service to send spam or unsolicited communications
• Misrepresent your identity or affiliation
• Circumvent any access controls or security measures

9. Intellectual Property

The Service and its original content, features, and functionality are owned by My India Now and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

This includes but is not limited to:

• The SmartWallet AI name and logo
• Application design and user interface
• Software code and algorithms
• AI models and insights generation
• Documentation and marketing materials

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

9.3 Restrictions

You may not:

• Copy, modify, or distribute the Application
• Create derivative works based on the Service
• Remove any copyright or proprietary notices
• Use our trademarks without prior written consent

10. User Content

10.1 Your Data

You retain ownership of all financial data, transactions, and other content you create or upload to the Service ("User Content"). By using the Service, you grant us a limited license to process your User Content solely to provide the Service.

10.2 Data Accuracy

You are responsible for the accuracy of your User Content. We do not verify or validate the financial information you enter.

10.3 Backup

While we implement measures to protect your data, you are responsible for maintaining backups of your important information. We recommend regularly exporting your data (Premium feature).

11.2 App Stores

Your use of the Service is also subject to the terms and conditions of the Apple App Store or Google Play Store from which you downloaded the Application.

Subscription payments are processed by Apple or Google. Their payment terms and privacy policies apply to those transactions.

12.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.2 No Financial Advice

SmartWallet AI is a financial tracking and management tool. We do NOT provide:

• Financial, investment, or tax advice
• Legal or accounting services
• Recommendations for specific financial decisions

AI-generated insights are for informational purposes only and should not be relied upon as professional financial advice. Consult qualified professionals for financial decisions.

12.3 Data Accuracy

We do not guarantee the accuracy, completeness, or reliability of:

• SMS-parsed transaction data
• Currency exchange rates
• AI-generated insights and predictions
• Category classifications

12.4 No Bank Affiliation

SmartWallet AI is not affiliated with any bank or financial institution. We do not have access to your bank accounts and cannot initiate transactions on your behalf.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS
• WE ARE NOT LIABLE FOR DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless My India Now, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content
• Any financial decisions made based on information from the Service

15. Termination

15.1 Termination by You

You may terminate your account at any time by:

• Cancelling any active subscription through your app store
• Deleting your account through Settings > Privacy > Delete Account

15.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if:

• You breach these Terms
• We are required to do so by law
• We discontinue the Service
• We detect fraudulent or abusive activity

15.3 Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and User Content
• Provisions that should survive termination will remain in effect
• You will not be entitled to any refund of subscription fees

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

16.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through:

1. Negotiation: The parties will first attempt to resolve the dispute through good-faith negotiations
2. Mediation: If negotiation fails, the parties will attempt mediation
3. Arbitration: If mediation fails, the dispute shall be resolved by binding arbitration in Pune, India

16.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the Application
• Sending an email notification (for significant changes)
• Displaying a notice in the Application

The "Last Updated" date at the top of these Terms indicates when they were last revised. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
