1. Acceptance of Terms

Welcome to SmartWallet AI Expense Tracker ("the App"), provided by My India Now Technologies ("we," "us," or "our"). By downloading, installing, accessing, or using the App or our website at smartwalletai.co, you agree to be bound by these Terms of Use and End User License Agreement (EULA).

If you do not agree to these terms, please do not use the App or access our services. Your continued use of the App constitutes your acceptance of these terms and any updates or modifications to them.

2. Subscription Terms (Auto-Renewable)

SmartWallet AI offers premium features through auto-renewable subscription plans:

Important Subscription Information:

• Payment: Payment will be charged to your Apple ID account (iOS) or Google Play account (Android) at confirmation of purchase.
• Auto-Renewal: Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription rate.
• No Refunds: No refund will be provided for the unused portion of a subscription period, except where required by law.
• Price Variations: Prices may vary by country/region and are displayed in the app at the time of purchase in your local currency.

How to Manage or Cancel Your Subscription:

• iOS Users: Go to Settings, then Your Name, then Subscriptions, then SmartWallet AI, then Cancel Subscription
• Android Users: Go to Google Play Store, then Menu, then Subscriptions, then SmartWallet AI, then Cancel Subscription

3. Free Trial

We currently do not offer a free trial for SmartWallet AI premium subscriptions. All subscription purchases begin billing immediately upon confirmation.

If a free trial is offered in the future, details will be displayed clearly in the app before any purchase, and the trial will automatically convert to a paid subscription unless cancelled before the trial period ends.

4. Use of the App

You agree to use SmartWallet AI only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Scrape, harvest, or collect data from the App through automated means
• Interfere with or disrupt the App's servers or networks
• Attempt to gain unauthorized access to any portion of the App
• Use the App to transmit malware, viruses, or harmful code
• Abuse, harass, or harm other users
• Circumvent any security features or access controls
• Use the App in any manner that could damage, disable, or impair our services

5. Accounts

When you create an account with SmartWallet AI, you are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or use of your account
• Ensuring your account information is accurate and up-to-date

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

6. Data and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy.

• We do not sell your personal data to third parties

7. User Content

SmartWallet AI includes AI-powered features such as chat assistance. You are solely responsible for any content you submit, input, or generate using these features.

You agree that:

• You will not submit content that is illegal, offensive, or violates any third-party rights
• You are responsible for the accuracy of financial data you enter
• AI-generated responses are for informational purposes only and do not constitute financial advice
• We may use anonymized, aggregated data to improve our AI services

8. Intellectual Property

All content, features, and functionality of SmartWallet AI, including but not limited to:

• Software code and algorithms
• User interface design and graphics
• Logos, trademarks, and brand elements
• Text, documentation, and marketing materials
• AI models and data analysis methods

are the exclusive property of My India Now Technologies and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Third-Party Services

SmartWallet AI integrates with and relies on third-party services to provide its functionality. These include:

• Apple Inc. - App Store distribution, in-app purchases, and payment processing for iOS
• Google LLC - Google Play distribution, in-app purchases, and payment processing for Android
• RevenueCat - Subscription management and analytics
• Supabase - Backend infrastructure and data storage
• OpenAI - AI-powered features and assistance

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

10. Disclaimer of Warranties

SmartWallet AI is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Results obtained from using the App will be accurate or reliable
• The App will meet your specific requirements
• Any errors in the App will be corrected

Any financial insights or AI-generated content are for informational purposes only and should not be considered professional financial advice. Always consult a qualified professional for financial decisions.

11. Limitation of Liability

To the maximum extent permitted by applicable law, My India Now Technologies and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities
• Any damages resulting from your use or inability to use the App
• Any unauthorized access to or alteration of your data

Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your access to SmartWallet AI at any time, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms of Use
• Fraudulent or illegal activity
• Conduct that harms other users or our services
• Non-payment of subscription fees

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Changes to Terms

We reserve the right to modify or update these Terms of Use at any time. When we make changes:

• We will update the "Last updated" date at the top of this page
• For material changes, we may notify you via email or in-app notification
• Your continued use of the App after changes constitutes acceptance of the updated Terms

We encourage you to review these Terms periodically to stay informed of any updates.

14. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or your use of SmartWallet AI shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts located in India.

15. Apple Standard EULA

In the event of any conflict between these Terms and the Apple Standard EULA, the Apple Standard EULA shall prevail for iOS users to the extent required by Apple's guidelines.
